Course Description

The objectives of the course are to:
- Identify the regulating organizations that govern attorneys' conduct.
- Compare and contrast the duties of a IV-D attorney as prescribed by the Cooperative Agreement and federal and state law.
- Identify the client of the IV-D attorney and understand the legal responsibilities in those representations in accordance with the professional rules of conduct and the Cooperative Agreement.
- Recognize issues of confidentiality in representation of the DRS and distinguish when to disclose information.
- Define conflicts of interest that are encountered in this representation and recognize how to avoid such conflicts.
- Identify legal malpractice pitfalls and what is required to provide competent representation.
- Identify situations where unauthorized practices of law may be an issue and discuss possible solutions.
- Distinguish between candor with the tribunal and influence over the tribunal.
- Apply the rules related to reporting professional misconduct, child abuse and/or public assistance fraud in the representation of the DRS.
- Review the Unified Judicial System (UJS) code of conduct governing judicial employees.
